ABOUT THE PREVIEWS

VALUE LEVELS

How the levels work

A Value level is an overall commercial judgement that can include content, duration, rarity, technical quality and how many similar clips are available. Prices are in Australian dollars per source clip and include GST. The standard licence is non-exclusive for one named production; the client, usage, advertising and any exclusivity may change the final price or require a custom quote.

.

If you think we may have valued a clip incorrectly, please email us. We are happy to review its Value level and reconsider the price. Email WILDFOTO.

LICENCE & PRICING

Standard non-exclusive project licence

After verified payment, the listed price licenses the selected original Archive master and Showcase non-exclusively for the single named production and its associated distribution and promotion.

Displayed prices are in Australian dollars per source clip, include GST, and cover this standard licence. Requirements outside it need a custom quote.

1. Licence record
The customer, named production, intended use, licensed clips, technical attributes, price and acceptance date recorded on the paid WILDFOTO invoice form part of this agreement.

2. Licence grant
After WILDFOTO has verified full payment, WILDFOTO grants the named customer a non-exclusive, non-transferable, worldwide licence for the duration of copyright to edit and use the selected original Archive master and its supplied Showcase solely as part of the named production. No ownership or copyright is transferred.

3. Permitted production use
The customer may incorporate the footage into the named production and distribute, exhibit, broadcast and communicate that production through television, cinema, streaming services, websites, social media, festivals and other production-release platforms. The customer may also use excerpts containing the footage in trailers, publicity and promotion directly connected with the named production.

4. Editing and production partners
The customer may crop, resize, colour-grade, stabilise, retime, add text, combine, edit and otherwise adapt the footage as reasonably required for the named production. The customer may provide necessary working copies to its employees, contractors, editors, post-production providers, broadcasters, distributors and platforms solely to make, distribute or promote that production. Those parties receive no independent right to use the footage, and the customer remains responsible for their compliance with this agreement.

5. Credit
Credit is a condition of this licence.

Where the named production or its normal publication format includes end credits, closing credits, acknowledgements, an online description or another suitable credit location, the customer must provide a clear credit substantially in the following form:

“Footage © WILDFOTO / Paul Thomsen”

Minor formatting adjustments are permitted to suit the production, provided that WILDFOTO and Paul Thomsen remain clearly identified.

If the production or platform would not ordinarily provide a suitable credit location, the customer must contact WILDFOTO before purchasing the footage. WILDFOTO and the customer must agree in writing on a reasonable alternative form and placement of credit. That agreed alternative will form part of the licence record.

If an agreed credit is inadvertently omitted, the customer must notify WILDFOTO promptly after becoming aware of the omission and correct it in the next reasonably available version, publication, description or credit update.

6. Prohibited uses
Without a separate written agreement, the footage must not be used in another production; sold, assigned, sublicensed or supplied as standalone footage; submitted to a stock library; used on merchandise; used in advertising, brand endorsement or a corporate campaign unrelated to promotion of the named production; used to train, test or develop an artificial-intelligence or machine-learning system; or used unlawfully or in a deliberately defamatory, deceptive or misleading context. Exclusivity is not included.

7. Ownership and reservations
WILDFOTO retains all copyright and ownership. WILDFOTO may continue using and licensing the footage to other customers. Rights not expressly granted by this agreement are reserved.

8. Technical suitability and remedy
The customer is responsible for deciding whether the disclosed subject matter and technical attributes suit the production. Showcase appearance may differ from the original Archive master because a Showcase may include interpretation, colour grading, noise reduction, stabilisation or other preview treatment. If a supplied file is materially defective or materially inconsistent with the technical attributes recorded on the invoice, the customer must notify WILDFOTO within seven days after the files are first made available. WILDFOTO may provide a corrected or replacement file. If that is not reasonably possible, WILDFOTO will refund the licence fee paid for the affected clip. This remedy does not apply to a change of creative preference or to an attribute disclosed before purchase.

9. Rights and clearances
WILDFOTO confirms that it owns, or is authorised to license, the copyright granted under this agreement. Unless the order expressly states otherwise, the customer is responsible for assessing and obtaining any additional permission or clearance required by the particular production context, accompanying material, claims or intended use.

10. Governing law
This agreement is governed by the laws of the Northern Territory of Australia and the applicable laws of the Commonwealth of Australia. The parties submit to the courts having jurisdiction in the Northern Territory.

I have read and agree to the licence terms, and I am authorised to accept them for the customer named in the order.
